This End User License Agreement ("Agreement") is between you and Abdulrahman Al-Rashdi, an individual developer ("Licensor", "we", "us"), and governs your use of the Masoon mobile application ("Masoon", "the app"). By downloading, installing, or using Masoon, you agree to this Agreement, including the Apple Minimum Terms in §10. If you do not agree, do not use the app.
Subject to your compliance with this Agreement and Apple's Standard EULA (which also applies to apps obtained through the App Store), Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use Masoon on Apple devices you own or control. This license covers your personal use, and, where you or your organization has purchased a group seat pack or household pack under §2, the use of the redeemed seat by the individual it was issued to. It does not permit reselling access to the app itself.
Masoon offers a 14-day free trial from your first active plan, and a free tier for pace settings below 0.5 page per day. Beyond that free floor, Masoon requires one of the following auto-renewing subscription plans, all billed through Apple (App Store / StoreKit) under Apple's terms:
Subscriptions automatically renew for the same period and price unless auto-renewal is turned off at least 24 hours before the end of the current period. You can view, manage, or cancel your subscription at any time in your device's App Store account settings; cancelling stops future renewal but does not refund the current period. We never charge you outside of Apple's billing system, and we never see your card or bank details.
You are responsible for the accuracy of the memorization progress you record. See the Privacy Policy for how your data is collected, stored, and, where you sign in, synced to our backend.
Masoon is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. Progress forecasts are estimates and are not guaranteed to be accurate. To the extent this warranty disclaimer is not permitted by applicable law, Licensor alone, and not Apple, is responsible for any product warranty, whether express or implied by law.
To the maximum extent permitted by applicable law, Licensor is not liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Licensor alone, and not Apple, is responsible for addressing any claims by you or a third party relating to Masoon or your possession and/or use of it, including: (a) product liability claims; (b) any claim that Masoon fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that Masoon, or your possession and use of it, infringes that third party's intellectual property rights, Licensor, and not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
This license is effective until terminated. It terminates automatically if you fail to comply with any term of this Agreement. Upon termination, you must stop using the app and delete it from your devices. Terminating this license does not cancel an active Apple subscription; cancel that separately in your App Store account settings.
We may update this Agreement from time to time. Material changes, including to pricing or subscription terms, will be reflected by an updated effective date and, where required, an in-app or App Store Connect notice before they take effect. Continued use of the app after an update means you accept the revised Agreement.
Because this Agreement is a licence agreement offered by Licensor rather than Apple, the following terms, required by Apple for third-party developer license agreements, apply in addition to the sections above:
You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist-supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable export and re-export control laws and regulations, and all applicable local laws and regulations regarding your use of Masoon.
This Agreement is governed by the laws of the Sultanate of Oman, without regard to its conflict-of-law principles, except where Apple's minimum terms in §10 or other App Store terms require otherwise.

تُبرَم اتفاقية ترخيص المستخدم النهائي هذه ("الاتفاقية") بينك وبين عبدالرحمن الراشدي، مطوّر فردي ("المرخِّص"، "نحن")، وتحكم استخدامك لتطبيق مصون ("مصون"، "التطبيق"). بتنزيلك التطبيق أو تثبيته أو استخدامه، فإنك توافق على هذه الاتفاقية، بما في ذلك حدود Apple الدنيا الواردة في القسم ١٠. وإن لم توافق، فلا تستخدم التطبيق.
رهناً بامتثالك لهذه الاتفاقية ولاتفاقية Apple القياسية لترخيص المستخدم النهائي (والتي تنطبق أيضاً على التطبيقات التي تُحصَّل عبر متجر التطبيقات)، يمنحك المرخِّص ترخيصاً محدوداً وغير حصري وغير قابل للتحويل وقابلاً للإلغاء لاستخدام مصون على أجهزة Apple التي تملكها أو تتحكم بها. يشمل هذا الترخيص استخدامك الشخصي، وكذلك، حيث تكون أنت أو مؤسستك قد اشتريتم حزمة مقاعد جماعية أو حزمة أسرية بموجب القسم ٢، استخدام المقعد المُفعَّل من قِبل الفرد الذي صدر له. ولا يُجيز هذا الترخيص إعادة بيع الوصول إلى التطبيق نفسه.
يقدّم مصون فترة تجريبية مجانية مدتها ١٤ يوماً من أول خطة نشطة لك، ومستوى مجاني لوتيرة حفظ أقل من ٠٫٥ صفحة يومياً. وبما يتجاوز هذا الحد المجاني، يتطلّب مصون أحد خطط الاشتراك التالية، المتجدّدة تلقائياً، وجميعها تُحصَّل عبر Apple (متجر التطبيقات / StoreKit) وفق شروط Apple:
تتجدّد الاشتراكات تلقائياً بنفس المدة والسعر ما لم يُوقَف التجديد التلقائي قبل ٢٤ ساعة على الأقل من نهاية الفترة الحالية. يمكنك مشاهدة اشتراكك أو إدارته أو إلغاءه في أي وقت من إعدادات حساب متجر التطبيقات على جهازك؛ والإلغاء يوقف التجديد المستقبلي لكن لا يُعيد ثمن الفترة الحالية. لا نُحصِّل منك أي مبلغ خارج نظام فوترة Apple أبداً، ولا نرى بيانات بطاقتك أو حسابك المصرفي.
أنت مسؤول عن دقة تقدّم الحفظ الذي تُسجّله. راجع سياسة الخصوصية لمعرفة كيفية جمع بياناتك وتخزينها، وحيثما سجّلت الدخول، مزامنتها مع خوادمنا.
يُقدَّم مصون "كما هو" و"حسب توافره"، دون أي ضمانات صريحة أو ضمنية، إلى أقصى حدٍّ يسمح به القانون. وتوقّعات التقدّم تقديرية وليست مضمونة الدقة. وبقدر ما لا يُسمح به قانوناً بإخلاء الضمان هذا، يكون المرخِّص وحده، لا Apple، مسؤولاً عن أي ضمان للمنتج، صريحاً كان أم ضمنياً بحكم القانون.
إلى أقصى حدٍّ يسمح به القانون المعمول به، لا يكون المرخِّص مسؤولاً عن أي أضرار غير مباشرة أو عرَضية أو خاصة أو تبعية ناشئة عن استخدامك للتطبيق. يكون المرخِّص وحده، لا Apple، مسؤولاً عن معالجة أي مطالبات منك أو من طرف ثالث تتعلّق بمصون أو بحيازتك و/أو استخدامك له، بما في ذلك: (أ) مطالبات مسؤولية المنتج؛ (ب) أي ادّعاء بأن مصون لا يتوافق مع أي متطلّب قانوني أو تنظيمي معمول به؛ و(ج) المطالبات الناشئة بموجب تشريعات حماية المستهلك أو الخصوصية أو ما شابهها.
في حال أي ادّعاء من طرف ثالث بأن مصون، أو حيازتك واستخدامك له، ينتهك حقوق ملكيته الفكرية، يكون المرخِّص، لا Apple، هو المسؤول وحده عن التحقيق في ذلك الادّعاء والدفاع عنه وتسويته وإبرائه.
يظلّ هذا الترخيص سارياً حتى إنهائه. ويُنهى تلقائياً إذا أخللت بأي بند من بنود هذه الاتفاقية. وعند الإنهاء، عليك التوقف عن استخدام التطبيق وحذفه من أجهزتك. إنهاء هذا الترخيص لا يُلغي اشتراك Apple النشط؛ ألغِ ذلك بشكل منفصل من إعدادات حساب متجر التطبيقات لديك.
قد نُحدّث هذه الاتفاقية من وقتٍ لآخر. وستظهر التغييرات الجوهرية، بما فيها تغييرات التسعير أو شروط الاشتراك، عبر تحديث تاريخ السريان، وحيث يلزم، عبر إشعار داخل التطبيق أو في App Store Connect قبل سريانها. ويعني استمرارك في استخدام التطبيق بعد التحديث قبولك للاتفاقية المعدَّلة.
نظراً لأن هذه الاتفاقية اتفاقية ترخيص يقدّمها المرخِّص وليس Apple، تنطبق الشروط التالية، التي تشترطها Apple لاتفاقيات ترخيص المطوّرين من طرف ثالث، إضافة إلى الأقسام أعلاه:
تُقرّ بأنك لست موجوداً في بلد خاضع لحظر من الحكومة الأمريكية أو مصنَّف بلداً "داعماً للإرهاب"، وأنك لست مُدرَجاً في أي قائمة للحكومة الأمريكية للأطراف المحظورة أو المقيَّدة. وتوافق على الامتثال لجميع قوانين وأنظمة الرقابة على التصدير وإعادة التصدير المعمول بها، وجميع القوانين والأنظمة المحلية المعمول بها بخصوص استخدامك لمصون.
تخضع هذه الاتفاقية لقوانين سلطنة عُمان، بصرف النظر عن مبادئ تنازع القوانين فيها، إلا حيث تقتضي حدود Apple الدنيا في القسم ١٠ أو شروط متجر التطبيقات الأخرى خلاف ذلك.
